Anti-Choice Group Using Gosnell Trial to Push TRAP Laws

The anti-choice group Americans United for Life is using the trial of Philadelphia abortion provider Kermit Gosnell – accused of infanticide and causing the injury and death of several women in his care – to push for “TRAP” laws meant to shut down safe abortion clinics.

TRAP – “targeted restrictions on abortion providers”—laws are a favorite tool of anti-choice activists trying to work their way around Roe v. Wade. Passed under the guise of improving care for women, they are in fact aimed at shutting down abortions providers by burdening them with onerous and unnecessary regulations. A TRAP law in Virginia forced a respected 40-year-old abortion clinic to close this month. Last year, Mississippi passed a TRAP law aimed at shutting down the state’s only abortion clinic.

And this is exactly what Americans United for Life wants more of. In a press release today, AUL president Charmaine Yoest presents two model state-level TRAP measures, falsely claiming that her group “has led the nationwide effort to combat the reality of legalized ‘back-alley’ abortions”:

"For more than a decade, Americans United for Life has led the nationwide effort to combat the reality of legalized 'back-alley' abortions, advocating for meaningful and comprehensive regulation and oversight of abortion clinics.  And legislators across the country are responding to AUL's call to protect women from substandard abortion clinics and providers.  Over just the last three years, eight states have enacted new comprehensive abortion clinic regulations or made significant improvements to existing regulations.

"Commonsense regulations must be a national priority. Enacting medically appropriate and comprehensive abortion clinic regulations is a critical and sensible solution to the on-going problem of unsafe, legal 'back-alley' abortions, which is now better understood as a result of the horrific revelations in the Gosnell trial.  These regulations are designed to safeguard against unsanitary conditions, inferior equipment, and the employment of unsuitable and untrained personnel.  They are also intended to put an end to substandard medical practices that injure and kill untold numbers of women each year."

Of course, these laws do nothing to prevent back-alley abortions or “safeguard” women’s health. Instead, they serve to force safe clinics out of business, forcing women into unsafe practices like Gosnell’s. Gosnell’s squalid and dangerous clinic was the last refuge for many low-income women in Philadelphia. Yet AUL and its allies are trying to exploit the Gosnell story to make it even harder for women to access safe abortion care.

Komen Crisis Reveals Breathtaking Hypocrisy of Anti-Choice Activists On Friday, we reported on how Religious Right groups reacted furiously to the Susan G. Komen for the Cure Foundation’s move to roll back their decision to stop funding Planned Parenthood under the excuse that they won’t work with groups under federal investigation — as Rep. Cliff Stearns (R-FL) opened a politically charged investigation into the women’s health organization.

Many Americans were perplexed by a move that would terminate potentially life-saving healthcare for tens of thousands of women in order to cater to the “pro-life” movement and few knew that for years the anti-choice community has campaigned and criticized the Komen foundation for its partnership with Planned Parenthood. So-called “pro-lifers” regularly attacked Komen for giving grants to Planned Parenthood to provide clinical breast cancer screenings and mammogram referrals for women who may otherwise not be able to obtain them since they are uninsured or underinsured and may not have a primary care provider.

However, while anti-choice activists congratulated themselves for pushing Komen to end their partnership with Planned Parenthood, they attacked people who criticized Komen’s decision for their “bullying,” “mafia shakedown” and “gangsterism.”

Two major groups that claimed credit for having Komen cut its ties with Planned Parenthood are now attacking supporters of Planned Parenthood for doing similar advocacy work.

Concerned Women for America CEO Penny Young Nance called Komen’s initial decision a “major victory for the pro-life movement” and boasted that “CWA helped usher in” the investigation which Komen used as an excuse to end its work with Planned Parenthood. But on Friday, Nance denounced the “mafia-style shakedown of the Susan G. Komen Foundation.”

Americans United for Life president Charmaine Yoest also released a blistering statement on the “ugly and disgraceful shakedown” of Komen and Planned Parenthood’s “scorched-earth strategy”:

As a breast cancer survivor, I am troubled that the Komen Foundation has come under such heavy fire for their recent decision to tighten and focus their funding guidelines. This week we have all been witness to highly partisan attacks from pro-abortion advocates and an ugly and disgraceful shakedown that highlights Planned Parenthood’s willingness to pursue a scorched-earth strategy to force compliance with their pro-abortion agenda.

Contrast that with what Yoest said in support of Komen’s initial decision to defund Planned Parenthood:

As a breast cancer survivor, I applaud the decision made by the Komen Foundation to discontinue their partnership with the billion-dollar, abortion mega-provider, Planned Parenthood. The work of the Komen Foundation has life-saving potential and should not be intertwined with an industry dealing in death. When I learned that the foundation was using donated funds to support abortion providers, I stopped running in the Susan G. Komen Race for the Cure. In the future, I’ll be racing with them to support this courageous decision.

Komen says it is halting its funding of Planned Parenthood due to public pressure from pro-life groups and the impending Congressional investigation of the abortion giant. According to a report from the Associated Press, “Many of the allegations [which sparked the Congressional investigation of Planned Parenthood] were outlined in a report presented to Stearns last year by Americans United for Life, a national anti-abortion group, which urged him to investigate.” [emphasis mine]

See that? The “public pressure from pro-life groups” on Komen and the AUL-inspired Stearns investigation was a great achievement, but advocacy to convince Komen to reverse their decision is “scorched earth” politics.

For Yoest, dubbed “the woman who got Komen to defund Planned Parenthood,” and other anti-choice zealots, the only acceptable advocacy work allowed is their own. AUL has now shut down and scrubbed their Team Life group for an upcoming Komen-sponsored marathon. But when opponents of Komen’s move to cutoff Planned Parenthood dollars did the same, AUL derided their “ugly and disgraceful” tactics.

Perkins Ignores Palin To Spin The 2008 Election Loss

Several weeks ago, the Family Research Council's Tony Perkins hosted a press briefing at the National Press Club to discuss just what it is that the Religious Right is seeking in a Republican presidential nominee.

During the Q&A, Perkins was asked to discuss the idea that the very positions that make a candidate appealing to the Religious Right are the same positions that make such candidates unappealing to the general voting population.

Not surprisingly, Perkins took issue with that assessment and asserted instead that without the support of the Religious Right, no Republican candidate can hope to win the general elections and pointed to John McCain as proof:

This idea that a candidate that would be supported by social conservatives that would win the Republican nomination would be unacceptable to the general populace is just not true. I think the opposite it true; we saw that in the last election cycle. There was a Republican nomination that was not acceptable to social conservatives. He did not have the enthusiastic support of social conservatives and, as a result, the Republicans lost the general election.

Now, obviously McCain and the Religious Right had a rather contentious history, but to say that the McCain campaign did not receive the "enthusiastic support of social conservatives" requires one to completely ignore the rapturous lovefest that exploded when McCain announced the selection of Sarah Palin as his running mate, which we chronicled at the time:

Jonathan Falwell: “John McCain made it very clear that his administration was going to be a pro-life administration, and he proved that’s his belief and his passion today with the choice of Sarah Palin.”

Jerry Falwell, Jr.: “I think it’s a brilliant choice.”

Charmaine Yoest, Americans United for Life: “And then when [Palin] was announced — it was like you couldn’t breathe. [We] were grabbing each other and jumping up and down.”

Gary Marx, Judicial Confirmation Network: "I can tell you that this pick tells millions in the base of the party that they can trust McCain. More specifically that they can trust him with Supreme Court picks and other key appointments’"

David Keene, American Conservative Union: “The selection of Governor Palin is great news for conservatives, for the party and for the country. I predict any conservatives who have been lukewarm thus far in their support of the McCain candidacy will work their hearts out between now and November for the McCain-Palin ticket."

If social conservatives were unenthusiastic about the McCain ticket last time around, some apparently forgot to tell all of these social conservatives who were gushing about just how thrilled they were. 

Anti-Choice Activists Remind GOP That Defunding Planned Parenthood is "Non-Negotiable"

Last week, a group of anti-choice activsts sent a letter to Speaker John Boehner and other Republican leaders declaring tha that "defunding Planned Parenthood must be a non-negotiable in the Continuing Resolution and we urge you to accept nothing less than this outcome."

That letter apparently didn't have much influence on Boehner, as just a few days later he admitted that Republicans have no intention of insisting that the provision to defund Planned Parenthood remain in the Continuing Resolution if that means shutting down the government.

But Religious Right anti-choice activists are continuing to draw a line in the sand, and dozens of them - including Tony Perkins, Tom Minnery, Penny Nance, Phyllis Schlafly, Charmaine Yoest, Richard Land, Marjorie Dannenfelser, Andrea Lafferty, and Bob Vander Plaats - have signed on to a new letter [PDF] to Speaker Boehner and Rep. Eric Cantor to ostensibly thank them for supporting efforts to defund Planned Parenthood and remind them that this issue is "non-negotiable"

Funding Planned Parenthood and its affiliates does not decrease abortion. Rather, it increases the incidence of abortion, while it also encourages irresponsible and sometimes illegal activities that harm young women. In addition, Planned Parenthood’s abortion machine massively outpaces its adoption referrals. In 2008 a woman entering a Planned Parenthood clinic was 134 times more likely to have an abortion than be referred for adoption.

As debate over the Continuing Resolution continues, you and your colleagues will undoubtedly receive pressure from Planned Parenthood and its allies. Spending must be reduced, and taxpayers do not need to be, and do not want to be, funding the abortion empire. Defunding Planned Parenthood is a non-negotiable for this budget.

We hope you will continue to champion the Pence provision to ensure that it is not removed during the legislative process.

Within hours of the release of Lila Rose's latest hoax video attack on Planned Parenthood, Religious Right anti-choice leaders had already lined-up in support and began using it to demand that the organization be de-funded.

Taking down Planned Parenthood has been a primary goal of the Religious Right for years and it looks like plans have been in the works to exploiting this latest video for some time now, because these same leaders have already launched a new effort called Expose Planned Parenthood complete with its own website:

A new website, Expose Planned Parenthood, went live late Tuesday backed by a coalition of national and local anti-abortion groups. The website, previewed exclusively to POLITICO, will serve as a hub for the movement’s efforts to bar Planned Parenthood from receiving any federal funds.

The new anti-Planned Parenthood campaign, led by Susan B. Anthony List and Live Action, also includes Concerned Women for America, Americans United for Life, 40 Days for Life, Students for Life, the Family Research Council, and New Jersey Right to Life.

“If there is a point where we can say ‘this is too much,’ this is it,” Susan B. Anthony List president Marjorie Dannenfelser told POLITICO. “Contributing to a group willing to be a chief ally in the exploitation of women and girls is indeed too much. Taxpayer support of Planned Parenthood is just that.”

The site hosts an online action center where anti-abortion activists can lobby their members of Congress to support Rep. Mike Pence’s (R-Ind.) Title X Abortion Provider Prohibition Act, which would strip the group of federal funding. The outreach campaign will ask activists to lobby members through emails, letters to the editor and letters to local Congressional offices.

Religious Right Leaders Rush To Embrace Hoax Video Attack on Planned Parenthood

As Brian noted earlier, Live Action has finally gotten around to releasing its hoax video attack on Planned Parenthood, despite the fact that Planned Parenthood had already reported the "potential sex trafficking" to law enforcement officials.

And despite the fact that Live Action's Lila Rose got her start working with James O'Keefe and that this new video heavily resembles O'Keefe's own notorious ACORN smear job, Religious Right are already lining-up behind Rose and using the video as an excuse to attack Planned Parenthood:

And despite the fact that Live Action's Lila Rose got her start working with James O'Keefe and that this new video heavily resembles O'Keefe's own notorious ACORN smear job, Religious Right are already lining-up behind Rose and using the video as an excuse to attack Planned Parenthood:

Most of the witness are to be expected, but some -like Tony Perkins and Charmaine Yoest - are rather surprising.

And then there is Jerry Boykin.  Really? That guy is completely off the rails.

He's the one who was forced to retire after declaring that we were engaged in a spiritual war with Islam that "will only be defeated if we come against them in the name of Jesus," saying that knows we will eventually win because our God is bigger than theirs.

Since then, Boykin has become a fixture on the fringe right-wing circuit, teaming up with the likes of  "Christocrat" Rick Scarborough and Dominionist Janet Porter and even sharing the stage with professional anti-gay activists like Peter LaBarbera.

In fact, Boykin is also on the Board of Rick Joyner's Oak Initiative which I wrote about just earlier today, along with Porter, Lou Sheldon, and Cindy Jacobs.

This is who Senate Republican want to bring it in testify against Kagan?  The mind reels.

FRC Planning $100,000+ Anti-Kagan Ad Campaign

I haven't really been writing much about the right-wing campaign against Elena Kagan ... mainly because the campaign against her has been so utterly predictable and ineffective.

Conservative groups continue to attack her even though, as Ed Whelan says, "Kagan is a safe bet to be confirmed, but it’s still important that conservatives use the opportunity to educate the public about the proper role of the court."

And so to that end, right-wing groups are planning on raising (and spending) hundreds of thousands of dollars on opposing Kagan's nomination

“We MUST raise $360,000 by June 30 in order to continue the momentum of our life-saving work!’’ [American's United for Life] president, Charmaine Yoest, wrote to her followers. Activist groups of all persuasions are using similar appeals.

...

[The Family Research Council's Tom] McClusky said his group expects to invest $100,000 to $150,000 in a Web and print campaign that highlights Kagan’s opposition to the don’t-ask, don’t-tell policy that forbids openly gay armed service members.

...

Other groups are also busy with anti-Kagan videos. Curt Levey, director of the conservative Committee for Justice, said his group is producing anti-Kagan TV ads, likely to air shortly before the final confirmation vote.

“How much we can air them, of course, depends on how much money we can raise,’’ Levey said. His group spent about $15,000 last year opposing Supreme Court nominee Sonia Sotomayor. Fund-raising currently is ahead of last year’s pace, he said.

Levey hopes to target the ads at Democratic senators in conservative states, such as Ben Nelson of Nebraska and Jon Tester of Montana. In states without expensive media markets, a small investment can have a large impact, he said.

Pressure on Democrats in conservative states will be strong, predicted Gary Marx, director of the conservative Judicial Crisis Network, which is spreading its research into Kagan’s record through new social media and by traditional radio interviews and phone banks.

I have to say that I am rather amazed with the types of people the Family Research Council has been associating itself with recently.  In addition to regularly paring-up with Lou Engle, it looks like FRC is now including Joseph Farah in its activities

Religious Right Claims Victory With Stupak Amendment

To say that the Religious Right is overjoyed by the passage of the Stupak Amendment, which makes it "virtually impossible for private insurance companies that participate in the new system to offer abortion coverage to women," would be a massive understatement.

The Right hasn't had much to cheer about lately, but a quick look at the statements released shows that while they are still militantly opposed to healthcare reform, anti-choice activists are downright giddy with this victory, with the Christian Defense Coalition proclaiming that it "pounds a nail in the eventual coffin of 'Roe v. Wade'":

"This historic vote in the United States House of Representatives signals the beginning of the end for 'Roe v. Wade.' President Obama made taxpayer funded abortions a key part of his presidential campaign and it was strongly supported by Speaker Pelosi and House leadership.

"Pro-choice groups spent millions of dollars to have taxpayer funded abortions included in healthcare legislation to no avail.

"It is important to note that taxpayer funded abortions were excluded from the healthcare bill because of the votes of Democrats in the House, not conservative Republicans. This vote shows what recent national polls have demonstrated, and that is -- America is turning away from abortion and embracing human rights and a culture of life.

Randall Terry:

Mr. Terry states: "This is a great first step to victory - a touchdown in the first quarter - but we have a lot of fighting ahead of us. Our rejoicing must be tempered by reality. The 176 Republicans and 64 Democrats who stood together in a bipartisan defense of life deserve our sincere gratitude. For many of these Members, this vote was cast in the face of serious pressure to oppose the amendment. While there is work yet to do on this issue, this vote represents an extremely significant victory for life.

  • The right-wing healthcare webcast from last night is now available on-line.
  • David Brody: Domestic Policy Council Director Melody Barnes and White House Director for Public Liaison Tina Tchen will meet with Dr. Charmaine Yoest, President and CEO of Americans United for Life Action, next Thursday.
  • Carrie Prejean will be a keynote speaker at the North Carolina Conservative Leadership Conference.
  • Conservative HQ: Longtime conservative Richard A. Viguerie, Chairman of ConservativeHQ.com, provided training to about 120 Tea Party leaders at a seminar he held in conjunction with the group's march on Washington, D.C.
  • Joseph Farah says that President Obama should be impeached for the "audacious plot of the White House to harvest personal e-mail addresses from Facebook, MySpace and other social networking sites for political purposes." Of course, none of that is true.
  • Finally, the effort to place a "Personhood Amendment" on the Florida ballot would likely end up outlawing birth control.

Right Unites to Fight Health Care Reform

We have been collecting everything that the Religious Right has been saying about efforts to pass health care reform for an upcoming Right Wing Watch In Focus report and, in doing so, quickly noticed that their primary focus was on claiming that any such plan would lead to public financing of abortion.

Until recently, activists and organization had been primarily making this case individually, but now it looks like several of them have decided to team-up for a nationwide webcast tomorrow evening:

Pro-life groups, including Focus on the Family, are hosting a webcast Thursday at 9 p.m. EDT to educate and mobilize pro-lifers against President Obama's healthcare reform bill, which currently mandates public and private insurance coverage of abortion.

The healthcare reform has hit a roadblock in the House Committee on Energy and Commerce. Fiscally conservative Democrats, known as Blue Dogs, have balked at the cost of the plan.

Pro-life advocates are hoping the delay allows them to marshal support for amendments that would take the federal funding of abortions out of the bill.

"We are advocating amendments that would simply remove any mandates for abortion, remove any federal subsidies for abortion," said Douglas Johnson, legislative director of the National Right to Life.

Others agree that this is a watershed event for the pro-life movement.

Marjorie Dannenfelser of the Susan B. Anthony List said: "It is without question the biggest event since Roe v. Wade when it comes to the pro-life issue."

Participants include James Dobson, Charmaine Yoest, Tony Perkins, Frank Pavone, Marjorie Dannenfelser, Wendy Wright, Tom Minnery, Rep. Chris Smith, Richard Land, Day Gardner, and several others, including Mike Huckabee, according to Dan Gilgoff.

A coalition of anti-abortion groups is set to open a new front against Democrats’ efforts to restructure American health care, claiming the plans open a back door to publicly financed abortions.

The groups, which are launching a broad campaign on the issue this week, claim that existing health care proposals constitute a stealth “abortion mandate” that will spend taxpayer money on abortions and require insurance companies to cover abortions — allegations that health care reform supporters call misleading.

“President Obama keeps on talking about common ground, and there is really, really common ground on funding issues,” said Charmaine Yoest, president of Americans United for Life, the group organizing the planned three-week campaign on the issue. “Almost no one wants to fund abortion, regardless of their position on abortion as a whole.”

Yoest’s group plans to release a letter to Barack Obama on Thursday in which it cites, according to its reading of proposed legislation, “our belief that the bills are intended to include abortion.”

The noisy, contentious health care debate — which has grown pointedly acrimonious in recent days — has proceeded largely without reference to abortion. But the decision of these high-profile conservative groups to launch the new campaign under the rubric “Stop the Abortion Mandate” may change that and provide a new obstacle to the reform legislation.

The leaders involved include Christian conservatives such as James Dobson, the founder of Focus on the Family; Family Research Council President Tony Perkins; and the Southern Baptist Convention’s Dr. Richard Land, who will be launching the push in a webcast Thursday evening.

“We just realized how urgent the situation was, what was at stake,” said David Bereit, the national director of 40 Days for Life, another group involved in the campaign, which will focus on generating pressure on members of Congress to insist on an explicit ban on abortion within the legislation.

Right Seeks An Extra Month To Mount Anti-Sotomayor Campaign

The Senate Judiciary Committee has an Executive Business Meeting for tomorrow at which Sonia Sotomayor's nomination to the Supreme Court will be on the schedule.  It is widely expected that Committee Republicans will seek a one-week delay on the vote, pushing it back until July 28th.

President Obama has made it clear that he wants to see a confirmation vote in the Senate before it leaves for its August recess, which is scheduled to begin on August 10th.

That would leave the Senate with a little more than a week to bring her nomination to the floor for a vote and it is assumed that efforts to get her confirmed before the recess will be successful ... and that is, predictably, angering right-wing groups who hope to use the August recess to try and build a campaign to oppose her nomination:

Republicans had their own political pressures as well. With seven GOP men on the Judiciary Committee, they did not want to appear overly aggressive with Sotomayor, who would become just the third female justice. And given that they lack enough votes to sustain a filibuster, even if they wanted to, attempting to delay the seating of a nominee who will almost certainly be confirmed would likely cost them support from Latinos, a fast-growing constituency that is already voting heavily Democratic. As a result, they're backing down on earlier demands to delay a final vote until September.

"In any case, conservatives will not be happy if the GOP rolls over with regard to Obama's politically motivated goal of getting Sotomayor confirmed before the August recess," said Curt Levey, head of the conservative group Committee for Justice.

While some conservatives say that GOP senators effectively laid out inconsistencies in her testimony, activists want the slow-news month of August - when Congress is on recess – to build a campaign opposing her nomination.

Charmaine Yoest, head of the anti-abortion group Americans United for Life who testified against Sotomayor, said that an extra month would be helpful to her cause.

"The more time we have to educate people, the more we would continue to emphasize to people that a vote for her is a vote for abortion on demand without any restrictions whatsoever," Yoest said.

Presumably, as the August deadline approaches, we'll be hearing a lot more from Manuel Miranda and his Third Branch Coalition, which has made delaying Sotomayor's confirmation vote until September a test of loyalty  for GOP senators and been consistently urging the use of a filibuster in order to achieve the desired delay.

Whether or not Republicans in the Senate bow to the Right's demands remains to be seen.

The anti-choice group Americans United for Life is using the trial of Philadelphia abortion provider Kermit Gosnell – accused of infanticide and causing the injury and death of several women in his care – to push for “TRAP” laws meant to shut down safe abortion clinics. Several weeks ago, the Family Research Council's Tony Perkins hosted a press briefing at the National Press Club to discuss just what it is that the Religious Right is seeking in a Republican presidential nominee. During the Q&A, Perkins was asked to discuss the idea that the very positions that make a candidate appealing to the Religious Right are the same positions that make such candidates unappealing to the general voting population. Last week, a group of anti-choice activsts sent a letter to Speaker John Boehner and other Republican leaders declaring tha that "defunding Planned Parenthood must be a non-negotiable in the Continuing Resolution and we urge you to accept nothing less than this outcome." That letter apparently didn't have much influence on Boehner, as just a few days later he admitted that Republicans have no intention of insisting that the provision to defund Planned Parenthood remain in the Continuing Resolution if that means shutting down the government. Last night, anti-choice leaders gathered together for a webcast organized around Live Action's latest video hoax attacks on Planned Parenthood and it was pretty much just an hour of Religious Right leaders and Rep. Mike Pence calling for a defunding of Planned Parenthood. But there were a few interesting points, like when Abby Johnson, a former Planned Parenthood employee who - when she feared she was going to be fired - decided to rebrand herself as an convert to the anti-choice movement, claiming that Planned Parenthood staffers are "required" to coerce women, especially minors,... Within hours of the release of Lila Rose's latest hoax video attack on Planned Parenthood, Religious Right anti-choice leaders had already lined-up in support and began using it to demand that the organization be de-funded.
